A new development in the recent case of CCMA v MBS Transport and 5 others has confirmed that an Award of the CCMA need only be certified by a Director of the CCMA in order to enforce it through the Sheriff, if it is a monetary award.
Previously, one would have to get the award signed off at the CCMA and then take that to the Registrar of the Labour Court, who would issue a Writ of Execution.
It is now all CCMA-based and will lead to the speedy and timeous execution of awards that are disregarded by employers who think the employee will become battle weary if they have to approach the Labour Court and run all over the place!
